Junk Fax Information

According to the Telephone Consumer Protection Act ("TCPA") it is unlawful for any business to send advertisements via facsimile. Unless a business relationship has been established or the recipient gave permission, "junk faxes" are completely illegal. Junk Faxes can create additional and excessive costs for many small and upcoming businesses. Filing lawsuits against senders of junk faxes takes very little effort on your part. Typically, the requirements are:

1) proof that the recipient's company owns the fax line

2) a signed retainer agreement for each case being pursued. The retainer agreement merely states that Anderson + Wanca represents you, the plaintiff, in a particular case.

By signing a retainer, your company should expect to become the Class Representative or Lead Plaintiff on the given case. The work required involves answering written questions and potentially participating in a deposition. If a deposition is required, one would be done at the time and place of the Plaintiff's choosing. The Lead Plaintiff is eligible for additional compensation compared to the class members for the time they have put into the given case.
